ARTICLE I – NAME

Section 1
This organization shall be known as Local 578, International Union, United Automobile, Aerospace, and Agricultural Implement Workers of America (UAW)

ARTICLE II – CONSTITUTION AND BYLAWS

Section 1
The Constitution of the organization shall be the Constitution of the International Union, UAW, and these Bylaws shall be in all respect subordinate to said Constitution and applications and interpretations thereof.

ARTICLE III – FISCAL YEAR

Section 1
The fiscal year of the Local Union shall begin on January 1 and end on December 31.

ARTICLE IV - MEMBERSHIP

Section 1
The Local Union shall be composed of workers eligible for membership in the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW), over whom the local union has jurisdiction.

Section 2
Eligibility for acceptance into the Local Union shall be set forth in Article 6 of the International Constitution.

Section 3
Each member in good standing of this Local Union has the right to nominate and vote, express opinions on all subjects before the Local Union, to attend all membership meetings and express views, arguments, and opinions on all matters and business, including candidates for office, properly before the meeting, to meet and assemble freely with other
members and generally to participate in the activities of the Local Union in a responsible manner consistent with good
conscience in order to present and discuss factually and honestly the issues and personalities upon which the membership must base its decisions.  These rights shall at all times be subject to the rules of procedure governing meetings and other uniform rules and regulations contained in the Constitution, Bylaws and other official rules of the Local Union.

A member, in exercising the foregoing rights and privileges, shall not take any irresponsible action which would tend to jeopardize or destroy, or be detrimental to, either the Local or International Unions as Organizations, or their free democratic heritage, or which would interfere with the performance by this Local Union of the International Union of its legal or contractual obligations of this Local Union as an affiliate of the International Union.

Violation, or abuse of these rights and privileges of membership, or engaging in conduct prohibited by this section, shall be considered conduct unbecoming of a union member.

The membership shall strive to obtain the objectives set forth in the International Constitution and additional objectives as established as the policy of the International Union, to maintain free relations with other organizations, to do all in its power to strengthen and promote the labor movement; to cooperate with Regional Board Members, the International Representatives, and help promote organizational activities. 

ARTICLE V – MEMBERSHIP MEETINGS

Section 1
There shall be a membership meeting once a month, September through May, with June, July and August meetings being suspended.  Meetings will be held at a time and place to accommodate all shifts.

Section 2
The Recording Secretary shall post notice of regular membership meetings, seven (7) days prior to the meeting.

Section 3
Special membership meetings may be called when deemed necessary by the President or the Local Union Executive Board.  No other business shall be transacted at such meetings, except that stated in the notice.

Section 4
A special membership meeting may be called upon request submitted by one-half of the members in good standing to the Executive Board.  The requests must be in writing, and shall state clearly the purpose for which the meeting is being called.  No other business shall be transacted at such meetings.

Section 5
The Recording Secretary shall post notice of a Special Membership Meeting twenty-four (24) hours prior to the meeting.

Section 6
The members in attendance at the meeting will constitute a quorum for the transaction of business.

Section 7
The regular membership meeting shall be conducted in accordance with Article 42 of the International Constitution.

Section 8
Any member who attends a meeting in an intoxicated condition, and/or creates a disturbance, or becomes unruly, shall lose voice and his/her right to vote at said meeting.  Where necessary to maintain order, the member may be evicted from the meeting by order of the chairperson, subject to the challenge of the membership.  Flagrant or persistent violation of this section by any member shall be conduct unbecoming a union member.

Section 9
Robert’s Rules of Order shall decide all questions of parliamentary nature.

ARTICLE VI – POWERS OF ADMINISTRATION

Section 1
The membership is the highest authority of this Local Union and shall be empowered to take or direct action not consistent with the Constitution or Bylaws.

Section 2
Between membership meetings, the Executive Board shall be the highest authority of the Local Union and shall be empowered to act on behalf of the membership to the extent urgent business requires prompt and decisive action, subject to subsequent membership approval, but the Executive Board may not take action affecting the vital interest of the Local Union without prior membership approval or authorization.

Section 3
Between meetings of Executive Board, the President shall exercise general administrative authority and shall be empowered to act on behalf of, and take action permitted to the Executive Board, subject to subsequent approval of the Executive Board and membership.

ARTICLE VII – LOCAL UNION OFFICERS

Section 1
The Local Union shall have the following Executive Officers: President, Vice President, Recording Secretary, Financial Secretary, Treasurer, three (3) Trustees, Sergeant-at-Arms and Guide.

Section 2
The election of Local Union Executive Officers shall be in accordance with Article 38, Section 5 of the International Constitution.

Section 3
The Vice President shall succeed to the Presidency in the event of a vacancy in that office, the office of the Vice President would be filled by a special election in the same manner as any other vacated Executive office would be filled. 

Section 4
Vacancies in Executive Offices, other than the Presidency, shall be filled promptly by a special election.  The special election shall be conducted under the same procedures as the original election and in accordance with Article 38, Section 2 of the International Constitution.

ARTICLE VIII – EXECUTIVE BOARD

Section 1
The Executive Board shall include the Executive Officers, Five (5) Board Members-at-Large, two (2) of which shall be the Chief Stewards, one (1) Board Member-at-Large, one (1) retired member from the Local Union’s Retirees’ Chapter, and one (1) Chief Steward (Skilled Trades), who shall have voice and vote.  All Executive Board Members shall be elected pursuant to Article 38, Section 5 of the International Constitution.  

Section 2
Special meetings of the Executive Board may be called by the President or by a majority of the Executive Board members.

Section 3
A simple majority of the Local Union Executive Board shall constitute a quorum.  Minutes will be taken of all Executive Board meetings by the Recording Secretary and shall be available to the membership at meetings.  All decisions and recommendations of the Executive Board shall be referred to the next regular membership meeting.  The Executive Board shall review each issue of the Local Union paper, and where necessary shall take steps to bring the contents and policy of the paper into conformity with the Policy of the International Union.     

Section 4
The Executive Board may direct payment of ordinary bills and expenses of the Local Union up to a maximum of $500 for any single disbursement.  All disbursements are to be reported to the next membership meeting for approval.

Section 5
No agent or official of the Local Union is authorized to execute a real estate lease, deed, service or maintenance contract or other long-term agreement unless the proposed agreement has been reviewed by an outside expert or attorney and approved by the Local Union Executive Board. 

Section 6
One (1) additional Chief Steward. The said Chief Steward will hold a seat on the Local 578 Executive Board and will be responsible for such duties as deemed necessary to represent it’s Membership. The said Chief Steward will represent the membership in accordance with the other Chief Stewards but will not per Agreement with U.A.W. Local 578 and Oshkosh Truck Corporation on October 1st 2006 be a member of it’s Bargaining Committee.  The Chief Steward
will receive all officer expenses and reimbursements as other Chief Stewards of the Local.
 
ARTICLE IX – BARGAINING COMMITTEE AND STEWARDS

Section 1
The Bargaining Committee shall be the President, Vice President, Recording Secretary, one (1) Board Member-at-Large , two (2) Chief Stewards, and one (1) Chief Steward (Skilled Trades), all to be elected by a majority vote for a three (3) year term.  The Chief Stewards shall be assigned a designated area of responsibility.  No member shall be eligible for election as a Bargaining Committee member of the Local Union until she/he has been a member in continuous good standing in the Local Union for one (1) year immediately prior to the nomination.

Section 2
Stewards shall be elected for departments or areas on all shifts as needed.

Section 3
Eligibility for election as Steward shall be one year of good standing in the Local Union.

Section 4
Nomination and election of Stewards shall take place in May.

Section 5
Stewards are nominated and elected by membership within each designated area shall serve for a three (3) year term.

Section 6
In the event of a vacancy in a Board Member-at-Large or Steward position, a prompt election shall be held.

Section 7
The three (3) Chief Stewards would also be three (3) of the five (5) Board Members-at-Large.

Section 8
The procedure for recall of a Steward or Committee person shall be in accordance with Article 45, Section 3, of the International Constitution.

Section 9
A vote on the question of recalling a Steward or Committee person may be initiated by a petition setting forth the reasons why the recall is sought and signed by at least 25 percent of the current members working under the jurisdiction of the Steward or Committee person must be present to establish a quorum.  A two-thirds vote of those members present and voting is necessary to recall.

ARTICLE X – COMMITTEES

Section 1
The Local Union shall have the following standing committees.  Constitution and Bylaws, Union Label, Community Services, Civil Rights, Education, Recreation, and Conservation, Citizenship and Legislative, Consumer Affairs, Veterans, Women’s, Retired Members, Job Evaluation, and
such other committees as deemed necessary.

Section 2
All committees and committee chairs, except the Election and Bargaining Committees, shall be appointed by the President, and are subject to approval by the Executive Board.

Section 3
The Union shall send a Bible of their religion to the immediate family of a member of UAW Local 578 at the time of death of his/her spouse, child, stepchild or foster child, sister, brother, parent, or parent-in-law.  Retirees shall also be included for the Bible of their religion.  This shall be limited to one bible per family per death.

Section 4
These committees shall perform all duties assigned to them by the Constitution and Bylaws, and such additional duties as they may be directed to perform from time to time by the Executive Board or membership.

ARTICLE XI – ELECTION COMMITTEE

Section 1
A special Election Committee to supervise each election the Local Union may conduct, will be nominated and elected every three (3) years at the February membership meeting.

Section 2
Membership will establish election dates of Executive Board election at the regular membership meeting in March in accordance with Article 38 of the Constitution of the International Union.

Section 3
Notice of nomination and elections of Local Union Executive Officers shall be poster on the bulletin boards in the plants, informing the nominations will be accepted at the April
membership meeting, stating Executive Offices to be filled, acceptance deadline date, and procedure of acceptance nominee should follow.

Section 4
A notice of Executive Officers Election shall be posted on the union bulletin boards in the plants at least fifteen (15) days before the election, stating the date, time, place, and Executive Offices to be filled.

ARTICLE XII – FINANCES

Section 1
The Local Union’s initiation fee shall be Twenty Dollars ($20).
The Local Union’s reinstatement fee shall be Twenty Dollars ($20).  A member is obliged to pay all dues owed.

Section 2 Officers’ wages













Section 3
The Local Union shall pay a representative or member lost time only when the representative or member is performing necessary duties for and on behalf of the Local Union, during the time for which s/he would otherwise be compensated by the employer.  The amount which the representative or member shall be paid, shall be his/her base rate, plus shift premium, if any, times number of straight hours.  Overtime hours are excluded.

Section 4
Travel expenses and expenses for delegates attending pre-paid convention and conferences shall be paid in accordance with the International Executive Board policy concerning per diem.  The current per diem standard is: ($________).  The current travel day per diem standard is: ($_______).
Date: _____/______/______ Hotel/motel is to be paid at the single room occupancy rate of one-half of a double room rate if shared with another member, plus the amount determined by the International Executive Board for meals.

Transportation is to be paid for the actual cost of airfare, not to exceed coach fare, or the amount determined by the International Executive Board per mile, whichever is more economical.  Expense for transportation will be paid for the actual mode of transportation used.  Mileage expense can only be paid to the driver of the automobile.  The current mileage standard is: ($_____). Date: ______/______/______

Section 5
Reimbursement to be paid to the President, Vice-President, and Chief Stewards of U.A.W. Local 578 in the amount up to and not to exceed fifty ($50) each month.  This is for cell phone use by the above while representing membership of this local.

ARTICLE XIII – ATTENDANCE

Section 1
All members of this Local Union holding an elective position are required to attend:

1.Two out of three consecutive membership meetings
  unless officially excused for cause by the Local Union
  Excuse Committee;
2.Two out of three consecutive meetings other than
  membership meetings expected of their respective
  office or position, unless officially excused for cause by
  the Local Union Excuse Committee;
3.Failure of any elected official to comply with the above
  attendance rules shall result in automatic removal from
  their respective office or position, and they shall not be
  permitted to run for any elective office for the balance
  of the term of office from which they were removed,
  except as a delegate to the International Constitutional
  Convention.

ARTICLE XIV – DELEGATES FROM LOCAL

Section 1
All delegates to International Conventions shall be chosen pursuant to provisions of Article 8 of the International Constitution.  The International Constitution controls eligibility of a member for Convention delegate,

Section 2
The President, Vice President, Recording Secretary, Financial Secretary, and Treasurer shall be delegates to area
Community Action Programs.

Section 3
The President of Local 578 shall have the option of attending all conventions, conferences and schools and may attend the Constitutional Conventions (as a Fraternal Delegate).

ARTICLE XV – ORDER OF BUSINESS

Section 1
The Local Union shall follow the order of business as established in Article 42 of the International Constitution.

ARTICLE XVI – APPEAL PROCEDURE

Section1
Any member dissatisfied with a decision of the Local Union or any of its representatives may appeal such decision to the membership.

Section 2
The appeal shall be made within sixty (60) days.

Section 3
The appeal must be submitted in writing to the Local Union’s Recording Secretary.

Section 4
Any appeal of the membership’s action to the International Union shall be in accordance with the International Constitution.

ARTICLE XVII – STRIKES AND STRIKE COMMITTEE

Section 1
All strikes shall be called or terminated only in strict conformance with Article 50 of the International Constitution.

ARTICLE XVIII – GENERAL

Section 1
All Local Union Officers, Committees, Stewards and other members handling funds or other property of the union shall, at the completion of their duties, turn over all papers, documents, funds, and/or union property to the properly constituted Local Union officers.

Section 2
Wherever in these Bylaws a pronoun is used it refers equally, where the reference is applicable, to both men and women in the singular and in the plural.

ARTICLE XIX – AMENDMENTS

Section 1
Any changes in these Bylaws shall be submitted to the Bylaws Committee for their recommendations in the following order:


A.)All changes must be submitted in writing to the
    Recording Secretary of UAW Local 578.
B.)The Bylaws Committee will then make its
    recommendations to the Executive Board and to the
    Membership of UAW Local 578.  The changes shall be
    voted on at the next Membership meeting.  Upon
    approval by (2/3) two-thirds of the Membership, these
    Bylaws shall be so amended.
C.)All approved changes in these Bylaws will be submitted
    to the UAW International Executive Board for their
    final approval.
